Protection With Patents

One of the most disastrous events that can happen to a is when they created a winning product only to have their competitors copy it and get an even larger profit from their idea. So it is recommended that once you have created a product that is unique, you should get a patent for it at once. Patents give you the protection you need because it provides you with the sole right to produce the product you had created. Thus your competitors have no choice but to abide by this law.

You should note though, that there is actually several kinds of protection you can derive from the government. As was mentioned earlier, one kind of protection is the patent. It is important to look deeper into this. A patent basically gives you the exclusive right to produce the product you had invented but this right is limited to a specific country and it is only applicable for a specific number of years. But there are qualifications for you to be able to get a patent. Some of these requirements include having a unique product that is new to the market and a clear process on how it can be produced. This is because a mere idea cannot be protected if you cannot manufacture it anyway.

As you can see, there are a lot of limitations in a patent. So if you want to be the sole manufacturer of a particular product worldwide then you should register your patent in every existing country. The patent will last for around 20 years but note that you need to register this patent every year after the first 4 years from the date it was granted. And remember that if you fail to register it on a particular year, then the patent is considered to be expired and other businesses will be free to produce this product as well.

Another type of protection you can derive is called the design rights. The design right can last for 15 years but this kind of protection is quite vague so if you think that another business has copied your product; it is difficult to prove that under the design right because the description of your product using this protection is not clear in the first place. Instead you can choose another form of protection to avoid this problem. This kind of protection is called the registered design.

The registered design can last for 25 years and it is more comprehensive compared to the design right. In fact, it covers almost all areas of your product including the color, the texture, the lines, the materials, the contours, and even the two dimensional design of your product.
